Healthy Food Community of Practice App End User License Agreement
This End User License Agreement (“Agreement”) is between you and Community Wealth Partners, Inc. (“CWP”) for the Healthy Food Community of Practice App and governs use of this app made available through the Apple App Store and Google Play Store. By installing the Healthy Food Community of Practice App, you agree to be bound by this Agreement and understand that there is no tolerance for objectionable content. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use the Healthy Food Community of Practice App.
In order to ensure CWP provides the best experience possible for everyone, we strongly enforce a no tolerance policy for objectionable content. If you see inappropriate content, please use the “Report as offensive” feature found under each post.
1. Parties
This Agreement is between you and CWP only, and not Apple, Inc. (“Apple”), Google LLC (“Google”) or Alphabet Inc. (“Alphabet”). Notwithstanding the foregoing, you acknowledge that Apple, Google, Alphabet and their subsidiaries are third party beneficiaries of this Agreement and Apple, Google and Alphabet have the right to enforce this Agreement against you. CWP, not Apple, Google or Alphabet, is solely responsible for the Healthy Food Community of Practice App and its content.
2. Privacy
CWP may collect and use information about your usage of the Healthy Food Community of Practice App, including certain types of information from and about your device. CWP may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the Healthy Food Community of Practice App.
3. Limited License
CWP grants you a limited, non-exclusive, non-transferable, revocable license to use the Healthy Food Community of Practice App for your personal, non-commercial purposes. You may only use the Healthy Food Community of Practice App on Apple or Google devices that you own or control and as permitted by the App Store Terms of Service.
4. Age Restrictions
By using the Healthy Food Community of Practice App, you represent and warrant that (a) you are 18 years of age or older and you agree to be bound by this Agreement; (b) if you are under 18 years of age, you have obtained verifiable consent from a parent or legal guardian; and (c) your use of the Healthy Food Community of Practice App does not violate any applicable law or regulation. Your access to the Healthy Food Community of Practice App may be terminated without warning if CWP believes, in its sole discretion, that you are under the age of 18 years and have not obtained verifiable consent from a parent or legal guardian. If you are a parent or legal guardian and you provide your consent to your child’s use of the Healthy Food Community of Practice App, you agree to be bound by this Agreement in respect to your child’s use of the Healthy Food Community of Practice App.
5. Objectionable Content Policy
CWP will moderate all content and ultimately decide whether or not to post or remove a submission to the extent such content includes, is in conjunction with, or alongside any, Objectionable Content. Objectionable Content includes, but is not limited to: (i) sexually explicit materials; (ii) obscene, defamatory, libelous, slanderous, violent and/or unlawful content or profanity; (iii) content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent; (iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms; and (v) gambling, including without limitation, any online casino, sports books, bingo or poker. You represent and warrant that you will not post any Objectionable Content and will defend, indemnify and hold harmless CWP for any violations of this policy.
6. Warranty
CWP disclaims all warranties about the Healthy Food Community of Practice App to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, CWP, not Apple, Google or Alphabet, shall be solely responsible for such warranty.
7. Maintenance and Support
CWP does provide minimal maintenance or support for it but not to the extent that any maintenance or support is required by applicable law, CWP, not Apple, Google or Alphabet, shall be obligated to furnish any such maintenance or support.
8. Product Claims
CWP, not Apple, Google or Alphabet, is responsible for addressing any claims by you relating to the Healthy Food Community of Practice App or use of it, including, but not limited to: (i) any product liability claim; (ii) any claim that the Healthy Food Community of Practice App fails to conform to any applicable legal or regulatory requirement; and (iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims.
9. Third Party Intellectual Property Claims
CWP shall not be obligated to indemnify or defend you with respect to any third party claim arising out or relating to the Healthy Food Community of Practice App. To the extent CWP is required to provide indemnification by applicable law, CWP, not Apple, Google or Alphabet shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the Healthy Food Community of Practice App or your use of it infringes any third party intellectual property right.
Healthy Food Community of Practice Privacy Policy

Community Wealth Partners, Inc. (“CWP,” “we,” “our,” “us”) offers a platform called the Healthy Food Community of Practice to its users which have subscribed and as such have a user account (hereafter,
the “Users”). The platform is available at the following url address https://healthyfoodcommunityhub.org/ (hereafter, the “Site”).
This Privacy Policy (“Policy”) describes how we collect, use, and disclose certain personal information obtained through the Site. The Site is hosted by Hivebrite, a solutions provider which enables the import
and export of user lists and data, the management of content and events, the organization of emailing campaigns and opportunity research and sharing as well as the management of funds and contributions of
any kind. By visiting our Site, becoming a User and/or using the features made available to you on the Site (the “Services”), you are agreeing to the terms of this Policy.
This Policy applies only to information collected through the Site and therefore does not apply to data we collect in other contexts.
What information we collect and maintain about you
We collect personal and other information from you directly when you provide it to us through the website. We may also automatically collect certain information about you and your computer,
smartphone, or other device when you use, access, or interact with our Site.
Personal Information. When subscribing to the Site, personal data is collected for the purpose of creating a user account. Such information could include, for example, your name, email address, phone number, or
job experience. The Site also allows Users to publish, at their own initiative, content on the Site, including posts to a “Live Feed” field, multimedia, posts to the pages of other Users, likes, comments and
discussion topics, through which additional personal information may be submitted, for example, data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, concerning sexual
orientation, etc. By providing such sensitive data, the User agrees to their processing by the Site in the conditions set forth in this Privacy Policy.
Web log data. When you use the Site, we automatically receive and record certain information from your computer (or other device) and your browser. This may include such data as your IP address and domain
name, the pages you visit on the Site, the date and time of your visit, the files that you download, the URLs from the websites you visit before and after navigating to the Site, your software and hardware
attributes (including device IDs), your general geographic location (e.g., your city, state, or metropolitan region), and certain cookie information (see below). To obtain such information, we may use web logs or
applications that recognize your computer and gather information about its online activity.
Cookies. We also use cookies on the Site. Cookies are small files that are stored on your computer by your web browser. A cookie allows the Site to recognize whether you have visited before and may store
user preferences and other information. For example, cookies can be used to collect or store information about your use of the Site during your current session and over time (including the pages you view and

whether a user has opened a particular email.
Third-party online tracking and behavioral advertising. We also may partner with certain third parties to collect, analyze, and use some of the personal and other information described in this section. For
example, we may allow third parties to set cookies or use web beacons on the Site or in email communications from us. This information may be used for a variety of purposes, including online
interest-based advertising, as discussed below (see the section entitled “With whom we share your information”).
How We Use and Process Your Information
We use the information that we collect for a variety of purposes. Our legal bases for processing your personal information are: 1) our legitimate interest in running and maintaining our business; 2)
performance and fulfillment of our contracts; 3) your consent; and 4) compliance with our legal obligations. In many instances, more than one of these legal bases apply to the processing of your

The purposes for which we use your information include to:

● Fulfill the terms of any agreement you have with us;
● Create and manage user accounts;
● Provide the User with all functionalities of the Site, meaning:
o Sending invitations for events organized by CWP or other Users, if the User has accepted
to receive such invitations;
o Sending offers from CWP or its partners if the User has accepted to receive such offers;
o Invite the User to events organized by the Site
● Manage data subjects rights according to law;
● Store User personal data;
● Make statistics in order to improve:
o the quality of the services proposed by the Site;
o the usage functionalities of the Site;
● Make statistics regarding the effective use of the Site;
● Make statistics regarding the different levels of activity on the Site.
● Enable the synchronization of the User’s LinkedIn profile; and
● Manage our business.
CWP may link information gathered through the Site with information that we collect in other contexts.
But in that event, we will handle the combined information in a manner consistent with this Policy.
With Whom and Why We Share Your Information
We share your information with other parties for a variety of purposes, as described below.
Third-party service providers. CWP uses third-party service providers that perform services on our behalf, including web-hosting companies, mailing vendors, and analytics providers. These service

We may share your information with other third parties when necessary to fulfill your requests for services; to complete a transaction that you initiate; to meet the terms of any agreement that you have
with us or our partners; or to manage our business.
Analytics. We partner with certain third parties to obtain the automatically collected information discussed above and to engage in analysis, auditing, research, and reporting. These third parties may use
web logs or web beacons, and they may set and access cookies on your computer or other device. In particular, the Site uses Google Analytics to help collect and analyze certain information for the purposes
discussed above. You may opt out of the use of cookies by Google Analytics here.
Legal purposes. We also may use or share your information with third parties when we believe, in our sole discretion, that doing so is necessary:
• To comply with applicable law or a court order, subpoena, or other legal process;
• To investigate, prevent, or take action regarding illegal activities, suspected fraud, violations

Aggregated information. From time to time, CWP may also share aggregated information about Site
users, such as by publishing a report on trends in the usage of the Site. Such aggregated information will
not identify you personally.
